1. Who we are
This Privacy Policy explains how Black&Tan Labs, LLC (“we,” “us”) collects, uses, and shares information when you use Areafans (the “Service”). By using the Service, you agree to this Policy.
2. Information we collect
- Account information: name or display name, email address, and your age attestation (a confirmation that you are 21 or older — we do not collect your date of birth).
- Team and fan information: the teams you follow, your votes, nominations, check-ins, streaks, status, and related activity.
- Location information: precise device location, collected only while you are using the app — at the moment of check-in to confirm presence at a venue, and to show nearby bars and your current area (including when you travel). You can control location permission in your device settings.
- Usage and device information: app interactions, device type, operating system, identifiers, and log data.
- Payment information (owners): billing is handled by Stripe; we do not store full payment card numbers.
- Communications: messages you send us and your email preferences.
3. How we use information
We use information to provide and improve the Service; confirm eligibility and prevent fraud; operate the evidence, status, and game features; personalize your experience; communicate with you (including transactional and, where permitted, marketing email); process owner subscriptions; ensure safety and enforce our Terms; and comply with law.
4. Location data
Location is used to verify game-time check-ins and to power presence and nearby-venue features, including recognizing the area you are in when you travel. We collect precise location only while the app is in use, never in the background, minimize what we store, and do not place location in URLs or share your precise location with other users beyond the presence features you choose to use.
5. Aggregated and de-identified data
We create aggregated and de-identified insights from Service activity — for example, counts and distributions of fans by team and metro area, and venue-level affinity. This data does not identify you. We may use and share aggregated or de-identified data with venues, brands, and partners, and for research, analytics, and business purposes. We do not sell your identifiable personal information for money.
6. How we share information
- Service providers who help us operate the Service (e.g., hosting/database, Stripe for payments, email delivery, analytics), under contract and limited to those purposes.
- Venues, only as needed for features you use (e.g., presence) and in aggregate/de-identified form per §5.
- Legal and safety: to comply with law, enforce our Terms, or protect rights and safety.
- Business transfers: in connection with a merger, financing, acquisition, or sale of assets.
7. Cookies and analytics
Our website and app use cookies and similar technologies for functionality and analytics. You can control cookies through your browser settings.
8. Your privacy rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain uses. California residents(CCPA/CPRA) have the right to know, delete, and correct personal information, to opt out of the “sale” or “sharing” of personal information, and not to be discriminated against for exercising these rights. To make a request, contact portal@areafans.com. We will verify and respond as required by law.
9. Do Not Sell or Share (California)
We do not sell your identifiable personal information for money. To the extent our aggregated or analytics practices constitute a “sale” or “sharing” under California law, you may opt out by contacting portal@areafans.com or using any opt-out mechanism we provide.
10. Data retention
We keep personal information for as long as your account is active and as needed to provide the Service, then retain and dispose of it in accordance with our retention practices and legal obligations. Aggregated and de-identified data may be retained indefinitely.
11. Security
We use reasonable administrative, technical, and physical safeguards to protect information. No system is perfectly secure, and we cannot guarantee absolute security.
12. Children
The Service is intended for users 21 and older. We do not knowingly collect personal information from anyone under 21. If we learn we have collected information from a child under 13 in violation of COPPA, we will delete it. Contact portal@areafans.com with any concern.
13. Email communications
Marketing emails include an unsubscribe link and our postal address, and we honor opt-outs promptly (CAN-SPAM). You may still receive transactional messages about your account.
14. Changes
We may update this Policy and will post the updated version with a new effective date. Material changes will be communicated as required by law.
