This End User License Agreement (“EULA”) governs your use of the Areafans mobile application (the “App”), provided by Black&Tan Labs, LLC. By downloading or using the App, you agree to this EULA, our Terms of Service, and our Privacy Policy. The Terms of Service apply in full to the App; this EULA adds the license and app-store terms below.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your personal, non-commercial use (or, for venue owners, to manage your venue account), in accordance with this EULA and the applicable app store’s terms.
2. Restrictions
You may not copy, modify, distribute, sell, or lease any part of the App; reverse engineer or attempt to extract its source code except as permitted by law; submit false location or check-in data; or use the App other than as permitted by this EULA.
3. Objectionable content and abusive users — zero tolerance
There is no tolerance for objectionable content or abusive users. By using the App you agree not to post objectionable content or engage in abusive behavior (as described in the Terms of Service). We provide tools to filter objectionable content, to report objectionable content and abusive users, and to block abusive users. We will act on reports of objectionable content and eject users who submit it or engage in abusive behavior, and we aim to remove violating content or users within 24 hours. 4. User content
You retain ownership of content you submit and grant us the license described in the Terms of Service. You are responsible for your content and must have the rights to it.
5. Location and privacy
The App collects precise location only while the App is in use — at check-in to verify presence, and to show nearby bars and your current area — as described in the Privacy Policy. You control location permission in your device settings.
6. App Store terms (Apple and Google)
This EULA is between you and the Company only, not with Apple, Inc. or Google LLC, and the Company (not Apple or Google) is solely responsible for the App and its content. To the extent required by the applicable app store:
- Scope of license: the license granted is limited to a non-transferable license to use the App on Apple/Google-branded or -operated devices you own or control, as permitted by the applicable Usage Rules.
- Maintenance and support: the Company, not the app store, is responsible for any maintenance and support, and neither Apple nor Google has any obligation to provide it.
- Warranty: the Company is responsible for any product warranties, which are not disclaimed by the app store; in the event of a failure to conform to any warranty, Apple may (for iOS) refund the purchase price, and to the extent permitted by law Apple has no other warranty obligation.
- Product and legal claims: the Company, not the app store, is responsible for addressing claims relating to the App, including product-liability, legal/regulatory, and intellectual-property claims, as permitted by law.
- Third-party beneficiary: you acknowledge that Apple and Google, and their subsidiaries, are third-party beneficiaries of this EULA and may enforce it against you.
- Legal compliance: you represent that you are not located in an embargoed country or on a prohibited-parties list, and that you will comply with applicable third-party terms when using the App.
7. Termination
This EULA is effective until terminated. Your rights end automatically if you fail to comply. We may suspend or terminate the license consistent with the Terms of Service.
8. Disclaimers and liability
The disclaimers and limitations of liability in the Terms of Service (§14) apply to the App and are incorporated here by reference.
